1. Eligibility and authority
You must be at least 18 years old to agree to these Terms. If an athlete is under 18, a parent or legal guardian must submit the application, agree to these Terms, and provide any required consents or releases on the athlete’s behalf. You represent that the information you provide is accurate and that you have authority to provide it.
2. Applications and services
Submitting an application does not guarantee acceptance, a particular coach, a specific start date, or availability. Training spots are limited and may be offered or declined at our discretion. The scope, schedule, pricing, duration, and other details of any in-person or remote coaching engagement will be stated in a separate order, invoice, program description, waiver, or service agreement. If those terms conflict with these Terms, the more specific written terms control for that service.
3. Athletic and medical disclaimer
Feole Pitching provides baseball coaching, athletic training guidance, and performance-development services. We do not provide medical diagnosis, treatment, physical therapy, or other licensed healthcare services. Training recommendations are educational and performance-oriented and are not a substitute for advice from a physician or qualified healthcare professional.
Baseball and athletic training involve inherent risks, including soreness, overuse, collision, falls, and serious injury. Athletes should disclose relevant injuries, restrictions, and workload information; stop activity that causes pain or concerning symptoms; and obtain medical clearance when appropriate. Participation may also require a separate informed-consent, assumption-of-risk, or liability waiver.
4. No guaranteed results
Individual results vary based on many factors, including health, age, training history, effort, attendance, recovery, nutrition, competition, and adherence to programming. Statistics, testimonials, velocity figures, commitments, draft outcomes, and other examples describe prior or individual experiences and do not guarantee similar results for any athlete.
5. Payments, scheduling, cancellations, and refunds
Pricing, payment timing, renewal terms, scheduling rules, cancellation windows, make-up sessions, program pauses, and refund eligibility will be disclosed before purchase or in a separate agreement. Unless those written terms provide otherwise, fees already earned or attributable to services, programming, assessments, or reserved coaching capacity are non-refundable to the fullest extent permitted by law.
6. Acceptable use
You may not misuse the website or services; interfere with security or operation; attempt unauthorized access; upload malicious code; impersonate another person; submit false or unlawful material; scrape, copy, or exploit content except as permitted by law; harass coaches or athletes; or use the services in a way that violates law or another person’s rights.
7. Intellectual property
The website and its text, graphics, branding, videos, training materials, program structures, and other content are owned by Feole Pitching or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use materials provided to you solely for your own participation in the applicable program. You may not publish, sell, sublicense, distribute, or commercially exploit them without written permission.
8. Athlete content and feedback
You retain ownership of videos, messages, and other content you submit. You grant us a limited license to host, copy, analyze, and use that content as needed to review an application, provide coaching, maintain records, and operate the services. We will not use an athlete’s name, image, likeness, testimonial, or identifiable performance footage for public marketing unless we have the permission required by law, including parent or guardian permission where applicable. Feedback and suggestions may be used without restriction or compensation.
9. Email and SMS terms
By providing contact information and selecting the applicable consent checkbox, you authorize Feole Pitching and its service providers to contact you about your application and services, including by email or text message. Where you expressly consent to marketing, you may also receive promotional messages. Consent to marketing texts is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts or HELP for help. Carriers are not liable for delayed or undelivered messages. You may unsubscribe from marketing email through the link in the message. Your use of communications is also governed by our Privacy Policy.
10. Third-party services
The website may use or link to third-party services for forms, communications, payments, scheduling, analytics, video, or social media. We do not control third-party services and are not responsible for their content, availability, or independent practices. Your use of them may be subject to separate terms.
11. Disclaimer of warranties
To the fullest extent permitted by law, the website and services are provided “as is” and “as available.” Feole Pitching disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and freedom from errors. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, Feole Pitching and its owners, coaches, staff, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or athletic outcomes arising from or relating to the website or services. To the fullest extent permitted by law, our aggregate liability for claims relating to the website or a service will not exceed the amount you paid to Feole Pitching for the service giving rise to the claim during the three months before the event giving rise to liability. These limitations do not apply where prohibited by law.
13. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Feole Pitching and its owners, coaches, staff, contractors, and affiliates from third-party claims, damages, liabilities, costs, and expenses arising from your misuse of the website or services, violation of these Terms, unlawful conduct, or infringement of another person’s rights.
14. Suspension and termination
We may suspend or terminate access to the website or services when reasonably necessary for safety, nonpayment, misconduct, violation of these Terms or a program agreement, disruption of services, or legal compliance. Provisions that by their nature should survive termination will survive, including intellectual-property, disclaimer, liability, indemnification, and dispute provisions.
15. Governing law and venue
These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-law principles. Unless applicable law requires otherwise, any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Rhode Island, and each party consents to their jurisdiction and venue.
16. General provisions
These Terms and any applicable service-specific agreement form the entire agreement regarding their subject matter. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer or by operation of law. Headings are for convenience only.
17. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date identifies the current version. Changes apply when posted unless another date is stated. Continued use after an update means you accept the revised Terms to the extent permitted by law.
